Terms of Use

1. Introduction

These Terms of Use ("Terms") govern your access to and use of the InsightFlow platform ("InsightFlow", "Platform", "Service"), operated by LocalLabs Pty Ltd (ABN 74 688 587 260) trading as InsightFlow ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all Terms, do not use the Platform.

2. The Service

InsightFlow is an AI-assisted research and insights platform that enables users to create, run and analyse studies, generate artefacts, and export results.

The Platform includes:

  • Study creation modules (research, persona, journey mapping, opportunity creation)
  • AI-generated interviewer prompts
  • Automated dashboards and study progress assessments
  • Visual and data-based exports (JSON, CSV, Excel, Markdown)
  • Optional add-ons such as real-time automated insights and premium reports

We may update or modify the Service at any time.

3. User Accounts

  • You must provide accurate account information and maintain the confidentiality of your login details.
  • You are responsible for all activity under your account.
  • You must notify us immediately of any unauthorised access to your account.

4. Payment & Billing

  • Pricing for studies, add-ons, reports and associated services will be displayed at checkout.
  • All fees are in AUD unless otherwise stated.
  • By purchasing a study or add-on, you authorise us (via Stripe) to charge your payment method.
  • Panel provider or recruitment fees are billed separately by the relevant third party unless explicitly bundled.
  • We may update pricing at any time with notice.
  • No refunds are provided for completed or partially completed studies unless required by law.

5. Intellectual Property Rights

5.1 Your Content

"Your Content" includes study questions, responses, raw research data, participant-level data and any materials you upload.

  • You retain full ownership of Your Content.
  • You grant us a licence to process, store and use Your Content solely to provide the Service.
  • We do not claim ownership over Your Content.
  • We do not resell, distribute, or publish Your Content.

5.2 Our IP

All intellectual property relating to InsightFlow, including the UI, platform logic, templates, AI prompts, algorithms, documentation, and derived features, remains owned by LocalLabs Pty Ltd.

6. Aggregated & Anonymised Data

We may use anonymised, aggregated data derived from multiple clients' studies for:

  • Benchmarking
  • Product improvement
  • Industry reports
  • Platform analytics
  • Academic or marketing insights

We will never use individual client data, identifiable study outputs or raw datasets in these materials.

7. Acceptable Use

You may not use the Service to:

  • Conduct unlawful research
  • Upload harmful or malicious content
  • Attempt to reverse engineer or disrupt the Platform
  • Collect data from minors without appropriate consent
  • Breach any panel provider requirements
  • Conduct research that violates ethical research standards
  • Deceive or manipulate research participants

We may suspend or terminate access for violations.

8. Third-Party Services

InsightFlow integrates with external services including:

  • Vercel (hosting)
  • Supabase (database)
  • Stripe (payments)
  • OpenAI (AI processing)
  • Google Analytics (analytics)
  • Panel provider tracking pixels / cookies

Your use of these services is subject to their respective terms.

9. Confidentiality

We treat all Your Content and study outputs as confidential unless you make them public.

10. Security

  • We use industry-standard security practices to protect your data.
  • No method of transmission is guaranteed to be 100% secure.

11. Disclaimers

  • InsightFlow provides automated insights and AI-generated material.
  • We do not guarantee accuracy, suitability or completeness for any purpose.
  • You are solely responsible for decisions made based on outputs.
  • AI-generated content should be reviewed and validated before use.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental or consequential damages.
  • Our total liability is limited to the amount you paid for the Service in the 3 months preceding the claim.
  • Nothing limits rights under Australian Consumer Law.

13. Indemnification

You agree to indemnify and hold harmless LocalLabs Pty Ltd from any claims arising from:

  • Your use of the Service
  • Your Content
  • Your violation of these Terms
  • Your violation of any third-party rights

14. Termination

  • We may suspend or terminate your access for any breach of these Terms.
  • You may stop using the Platform at any time.
  • Upon termination, you may request export of Your Content within 30 days.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or platform notification at least 14 days before taking effect.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
